This month, German corporation Fresenius Medical Care AG & Co. KGaA (“FMC”) reached a US$ 32 million FCPA resolution with the SEC and DOJ for violations of the anti-bribery, books and records, and internal accounting controls provisions of the FCPA.
From the early 2000s to approximately 2016, FMC -- through its various subsidiaries -- allegedly paid over US$ 30 million in bribes to various publicly-employed healthcare personnel and foreign government officials in nearly 17 different countries to retain and maintain business. The widespread scheme resulted in over US$ 141.2 million in ill-gotten profits.
