The General Data Privacy Regulation (GDPR) will take effect next month. This expansive regulation will not only impact data protection procedures, as currently drafted, it will have a significant impact on how companies can collect, transmit and store information about third parties in Europe. At the end of 2017, TRACE authored a position paper advocating for a legislative solution to the GDPR’s potential obstacles in Article 10 to anti-bribery due diligence. Since then we have made other considerable efforts to communicate our concerns to government officials both in the U.S. and in Europe with the goal of balancing the important but competing goals of privacy and transparency.

Join us on Wednesday, 2 May 2018 in Washington D.C. to learn more about these initiatives and to benchmark your GDRP compliance efforts with those of other companies. This is a unique opportunity to discuss your most pressing due diligence and data protection questions before GDPR takes effect 25 May 2018. The roundtable will be limited to 20 people to encourage discussion and will be followed by a complimentary networking reception.

Discussion topics will include:

  • Processing criminal convictions data (Article 10) as part of due diligence.
  • Processing sensitive Article 9 (e.g., political party names, photographs, etc.) data as part of due diligence.
  • The extraterritorial reach of the GDPR for "monitoring" behavior occurring in the European Union.
  • Applicability of multiple inconsistent national implementing laws in the EU to companies that are not "established" in the EU.
  • GDPR's data subject notification requirements in the context of due diligence.
